GENERAL TERMS AND CONDITIONS OF SALE, SHIPPING, EXCHANGES, RETURNS, WITHDRAWAL AND GUARANTEES

Important: These terms protect Sonpetit's commercial and operational interests within the limits permitted by mandatory consumer law. The Exchanges, Returns and Refunds Policy forms a complementary part of these terms.

1. Seller and scope

These Terms govern purchases made on sonpetit.com from SONPETIT BARCELONA S.L., Tax ID B65259988, with registered office at Carrer del Pi Gros, 10, 08349 Cabrera de Mar, Barcelona, Spain. They apply to consumers and, where appropriate, other buyers. B2B transactions may be subject to specific professional terms.

2. Acceptance

Before completing a purchase, the customer will have access to these terms. Confirming the order implies having reviewed the products, quantities, variants, address, price, shipping costs and applicable conditions. Mandatory consumer rights cannot be waived.

3. Capacity and representation

The buyer declares that they have sufficient capacity to contract. Anyone acting on behalf of another person or entity declares that they have authorisation. Sonpetit may request reasonable identity checks where there are objective indicators of fraud or security risk.

4. Product information

Sonpetit seeks to describe products correctly. In textiles there may be minor variations in shade, texture, print position or finish resulting from screens, lighting or manufacturing that do not substantially alter the conformity of the goods.

5. Use and care

The buyer must follow washing, drying, maintenance and use instructions. Damage caused exclusively by misuse, washing contrary to instructions, aggressive products, normal wear and tear, accidents or subsequent alterations does not by itself constitute a lack of conformity attributable to Sonpetit.

6. Prices and taxes

The applicable price is the price shown before the order is confirmed, except in the case of a manifest error. Taxes and charges that Sonpetit must collect will be shown before payment. For destinations outside the EU, customs duties, taxes, fees and clearance charges may be payable by the recipient unless a DDP service is expressly indicated.

7. Geolocation and territorial conditions

Sonpetit may estimate the country or region using the IP address or use the delivery address to display availability, currency, taxes and logistics rates. The address confirmed at checkout prevails over the technical estimate. The use of geolocation is governed by the specific policy.

8. Personalised price through automation

If, in any case, the price of a product were personalised through an automated decision, Sonpetit will inform the customer before contracting, indicate the parameters required by law and maintain the final price offered throughout the purchase process under the legally required conditions.

9. Promotions and Outlet

Promotions are limited to their validity period, products, units and published conditions. Discounted products retain statutory rights. A specific defect disclosed before purchase and accepted under the legally required conditions cannot later be claimed as though it had been concealed, without prejudice to any other different defect.

10. Manifest error

If a technical or human failure generates a manifestly incorrect and objectively recognisable price, discount, stock level or condition, Sonpetit may stop processing before the transaction is definitively consolidated and contact the customer. If a transaction that cannot validly be fulfilled has already been charged, the corresponding amounts will be refunded.

11. Availability

Orders are subject to stock. Simultaneous sales, inventory errors, damage detected during preparation or synchronisation failures may exceptionally cause unavailability. If a product cannot be supplied, Sonpetit will inform the customer and refund the corresponding amounts without undue delay.

12. Formation of the contract

The display of products constitutes an invitation to purchase. The order is the customer's request. The automatic acknowledgement confirms technical receipt, while commercial acceptance is subject to validation of payment, stock, anti-fraud checks and absence of manifest error, within legal limits. Sonpetit will not use this process to arbitrarily cancel validly concluded contracts.

13. Payment

Available payment methods may vary by country, currency, amount and provider. The transaction will proceed when payment is authorised. The payment provider may apply its own security and authentication controls.

14. Fraud prevention

Sonpetit may temporarily hold, verify or reject transactions where there are objective indications of unauthorised use of payment methods, impersonation, multiple anomalous attempts, promotion abuse, technical manipulation or a high risk of fraud. Measures will be proportionate to the risk.

15. Promotion abuse

Sonpetit may invalidate benefits obtained through artificially created multiple accounts, technical manipulation, unlawful use of codes, impersonation or deliberate exploitation of errors. Legitimate use of a promotion will not be considered abuse.

16. Order preparation

Orders are prepared according to availability, destination, characteristics and operational volume. Sonpetit may use quality checks, photographs, SKU records, weight, packaging and traceability to protect the transaction and prevent errors or fraud.

17. Shipping zones

Sonpetit ships only to countries and territories enabled in checkout. Africa, the Canary Islands, Ceuta, Melilla, Gibraltar and other expressly excluded special territories are not part of the automatic shipping zones.

18. Carriers

Sonpetit will select the carrier according to destination, cost, delivery time, weight, dimensions, availability and quality. FedEx may act as the main international operator, with DHL, UPS or other operators as alternatives, without this constituting a guarantee that a particular company will be used for every order.

19. Shipping rates

The rate charged to the customer is the rate shown at checkout and is governed by the current Shipping and Pricing Policy. Free-shipping thresholds and rates may be changed for future orders but will not be altered retroactively once an order has been confirmed.

20. Delivery times

Sonpetit will seek to meet the delivery times communicated. Unless otherwise agreed, orders to consumers will be performed within the general maximum statutory period applicable. Transit times may be affected by customs, the carrier, extraordinary incidents or destination restrictions.

21. Delivery address

The customer must provide a complete and correct address. Actual costs resulting from an incorrect address, repeated absence, failure to collect or unjustified refusal may be charged to the customer where legally permitted.

22. Transport risk

Where Sonpetit uses a carrier offered by the company, the risk of loss or damage does not pass to the consumer until the consumer or a third party indicated by the consumer physically receives the goods. If the consumer engages a carrier not offered by Sonpetit, the applicable statutory regime applies.

23. Delivery incidents

Customers are advised to check the external condition of the parcel and report visible damage as soon as possible, providing photographs where possible. This recommendation facilitates a claim against the carrier and does not reduce the consumer's statutory rights.

24. Customs and importation

Outside the EU, unless DDP is indicated, the recipient is responsible for customs duties, taxes, clearance and import charges. Refusing the parcel because these amounts are not paid does not turn the shipment into a free return.

25. Right of withdrawal

Where legally applicable, the consumer generally has 14 calendar days to communicate the decision to withdraw. The form, periods and costs are detailed in the Exchanges, Returns and Refunds Policy.

26. Direct cost of return

For withdrawals due to a change of mind, the consumer bears the direct cost of returning the goods where they were informed before purchase. Sonpetit does not assume free return transport unless expressly offered.

27. Use, washing and depreciation

Under its voluntary commercial policy, Sonpetit does not accept used or washed items. In a statutory withdrawal, the customer is responsible for any diminished value caused by handling beyond what is necessary to examine the nature, characteristics or functioning of the product. Sonpetit may document and deduct actual depreciation within legal limits.

28. Personalised products and hygiene

Clearly personalised goods and certain sealed goods that are unsuitable for return for health protection or hygiene reasons after being unsealed may be excluded from withdrawal where the legal requirements are met and the customer was informed in advance.

29. Refunds

Where withdrawal applies, Sonpetit will refund the payments legally required. It may withhold the refund until it receives the goods or valid proof of return, as applicable. The supplement for a more expensive delivery method than the least expensive standard method will not be refundable where the law permits.

30. Orders outside the EU and voluntary returns

Unless mandatory law in the consumer's country provides otherwise, for voluntary international returns the customer bears the original shipping, return, insurance, customs, taxes, clearance, surcharges, re-importation and other logistics costs. The original shipping cost is not refundable unless required by law.

31. Statutory guarantee

Sonpetit is liable for lack of conformity under the terms provided by law. For new goods sold to consumers in Spain, the current general period is three years from delivery. Bringing the goods into conformity will be free of charge where applicable.

32. Remedies

In the event of a genuine lack of conformity, the consumer may request the remedies provided by law. Sonpetit may refuse a specific remedy where it is impossible or disproportionate under the legal criteria, offering the applicable alternative.

33. Verification of defects

Sonpetit may request reasonable evidence—photographs, videos, labels, order number, batch, washing instructions and physical return—to verify a claim, without using those requirements to obstruct legitimate rights.

34. Fraudulent claims and chargebacks

Sonpetit may defend itself against fraudulent returns, product substitutions, duplicate refunds, falsification or unjustified chargebacks by providing the payment provider with legitimately available documentation. This does not limit rights relating to genuinely unauthorised transactions.

35. Product safety

Where there is a safety risk, Sonpetit may contact affected customers, issue instructions, withdraw products or take recall measures in accordance with applicable legislation.

36. Force majeure and extraordinary circumstances

Sonpetit is not liable for delays or impossibilities directly caused by extraordinary events outside its reasonable control to the extent permitted by law. This does not remove the customer's right to recover amounts where termination of the contract is legally appropriate.

37. Liability

Sonpetit is liable in accordance with applicable law and does not exclude liabilities that cannot legally be limited. It is not liable for damage caused exclusively by the customer's acts, use contrary to instructions or third parties outside its control where such damage is not legally attributable to Sonpetit.

38. Intellectual property

Purchasing a product does not transfer rights in Sonpetit's trademarks, designs, photographs, content or materials. Unauthorised exploitation outside legal limits is prohibited.

39. Data protection and cookies

The processing of personal data, fraud prevention, logistics management and purchase records are governed by the Privacy Policy. Cookies are governed by the Cookie Policy and geolocation by its specific policy.

40. Customer service

Queries regarding orders, returns, guarantees or incidents may be sent to info@sonpetit.com. Sonpetit may request reasonable information to verify the applicant's identity and locate the transaction.

41. Law and jurisdiction

These terms are governed by Spanish law, without depriving consumers of any mandatory protection that may apply to them. Consumer disputes will be resolved before the competent bodies under mandatory rules; B2B relationships may be subject to specific jurisdiction clauses.

42. Partial invalidity and legal precedence

If a clause is void or unenforceable, the remainder will continue in force to the extent possible. Any mandatory consumer-protection rule prevails over an incompatible term.

43. Amendments

The version applicable to an order will generally be the version in force when the order is placed. Sonpetit may update terms for future orders due to legal, logistics, technical, payment or security changes.

Annex II - Applicable shipping rates

Current rates are set out in Sonpetit's Shipping and Pricing Policy. Checkout will always show the applicable rate before payment. Excluded destinations cannot complete the automatic shipping process.
